Is it worth claiming for whiplash?

For many people, the thought of making a compensation claim after sustaining an injury is not an option that immediately springs to mind but for painful injuries such as whiplash, it is well worth considering.

Whiplash is a condition many people have heard of but often are not fully aware of the impact it can have on a sufferer's quality of life. More than just simple neck pain, whiplash can cause a whole range of symptoms including headaches, pins and needles, dizziness, exhaustion and visual disturbances as well as ringing in the ears. Although the majority of whiplash cases will resolve within four to eight weeks, residual symptoms can persist for longer and more severe cases will continue for prolonged periods of time, sometimes even years.

It is for this reason that that many people are turning to no win no fee solicitors to help them with a whiplash claim, as the money awarded can help sufferers with their quality of life whilst the symptoms continue. However, even if the condition resolves quickly, a compensation claim can still be considered as based on industry averages, a typical whiplash payout can be expected in the region of £200-£2500. More often, a compensation claim for whiplash is settled for around £3500. Those unlucky enough to be suffering from chronic and severe symptoms may be awarded £7750 or more. Even the mildest case can expect to be awarded a payment of around £500.

One of the key factors in determining the total payout is the length of time the symptoms persisted. As a general rule, if the condition resolved within 12 months, a payment of up to £2500 will be received. Those who continue to suffer for over a year but less than four years can expect an award of up to £7750. For the unlucky few whose symptoms continue for more than four years, an award in excess of £7750 is possible.

There can be many different causes for whiplash but even if you are partly at fault, a claim can still be considered. An experienced solicitor will be able to help with a whiplash claim in these cases as the amount awarded will be proportionate to the extent of responsibility apportioned for the incident.

The success of any compensation claim will hinge not only on the severity of the injury, but also the quality of the medical evidence presented and the experience of the solicitor handling the case. Anyone considering making a whiplash claim should not be required to make any payments to a solicitor upfront and may find using a no win no fee solicitor a better option.
